How Long You Have to File a Personal Injury Claim In Florida

According to Florida Statutes Section 95.11(5)(a) and (e) the statute of limitations for personal injury and wrongful death is two (2) years. This means you or your heirs have two years from the date of your injury or death to file an action or you risk losing your ability to file along with your right to pursue compensation.

It is important to note that there are several exceptions that can shorten or extend this two-year time period so it is important to speak with an experienced attorney about the details of your case as soon as possible.
